Title IX

 
Title IX of the Educational Amendments of 1972 is a federal law prohibiting gender discrimination in any school receiving federal funds.  The regulations have been updated and now cover all forms of sex discrimination and sex-based harassment.

Sex Discrimination under Title IX Includes discrimination based on sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity. 
 

What is Sex-Based Harassment under Title IX?

There are 3 categories that fall under Title IX Sex-Based Harassment:
  • Quid Pro Quo: promises made in exchange for sexual favors by an employee, agent, or person authorized by the District.
  • Hostile Environment Harassment: subjectively and objectively offensive and is so severe or pervasive that it limits or denies a person’s ability to participate in or benefit from the recipient’s education program or activity
  • Sexual Assault, Dating Violence, Domestic Violence, and Stalking

Is there a Statue of Limitations for filing an alleged incident of sex discrimination and/or sex-based harassment? 

For incidents occurring prior to August 1, 2024, complainants must be participating in or attempting to participate in the educational program or activity at the time of the complaint.
